Appellate Practice
Franke Schultz & Mullen, PC represents clients in appellate matters in federal and state courts and administrative agencies throughout the Midwest. Our attorneys have successfully argued before the Eighth and Tenth Circuit Courts of Appeal and at the intermediate and Supreme Court levels of the state courts in Missouri and Kansas as well as various administrative offices therein. We recognize that winning a difficult case on appeal requires more than citing the right legal precedent. Appellate practice requires a combination of specialized appellate advocacy, extensive trial court experience, and exceptional legal strategy, tactical analysis and brief composition. Our lawyers bring distinguished experience, knowledge and skills to the particular challenges of appellate advocacy. Our lawyers have played key roles before, during and after trial by developing legal strategies, ensuring that issues are properly preserved, and evaluating opportunities for appellate review of interlocutory orders as well as mandamus and prohibition proceedings. To ensure that our clients’ interests are appropriately served, as part of the overall litigation process, our attorneys analyze the costs and benefits of filing an appeal, including consideration of the likelihood of success on appeal, the costs of pursuing or responding to an appeal, and the ramifications of a potentially adverse precedent.
