Circuit Court of Jackson County, Missouri enters Summary Judgment in favor of insurer in liability coverage dispute

Sagamore Insurance Company filed a declaratory judgment action to determine its coverage obligations under a policy issued to 4-Way Trucking, LLC.  4-Way Trucking, LLC was sued in a separate action by FLS Transportation, Inc. after receiving a shipment of damaged steel.  The steel was allegedly damaged in transit due to the actions of 4-Way Trucking, LLC, the motor carrier hired to transport the load of steel.  Sagamore Insurance Company argued that its policy exclusions expressly excluded coverage for the damaged load of steel and therefore, Sagamore owed no duty to defend or indemnify 4-Way Trucking, LLC.  The Circuit Court of Jackson County, Missouri agreed and entered summary judgment in favor of Sagamore Insurance Company.
