Circuit Court of Jackson County Missouri Grants Summary Judgment to Client on Premises Liability Trip and Fall Suit

The Circuit Court of Jackson County, Missouri granted summary judgment in favor of firm client UMB Financial Corporation (UMB) in a premises liability suit where Plaintiff Marilyn Skipper alleged that she tripped and fell upon uneven bricks on a walkway outside of a UMB bank branch in Kansas City, Missouri.   UMB argued summary judgment was appropriate because Plaintiff, as a licensee, failed to provide evidence that the brick walkway was in fact a dangerous condition, and that UMB had actual knowledge of this purported dangerous condition before the alleged fall occurred.   Plaintiff was unable to provide any evidence to support these necessary elements of her premises liability claims and summary judgment was granted.   Firm partner Christopher Brackman represented and prepared the summary judgment briefing on behalf of client UMB.
