Federal Court Grants Summary Judgment to Local Brewery on Trademark and Trade Dress Infringement Claims

06/29/2018
The United States District Court for the Western District of Missouri granted summary judgment in favor of firm client Logboat Brewing Company, LLC, in a trademark and trade dress infringement case where Plaintiff Shipyard Brewing Company, LLC, out of Portland, Maine, alleged that Logboat’s Shiphead Ginger Wheat infringed on Shipyard’s trademarks and trade dress.  Logboat, a brewery located in Columbia, Missouri, argued summary judgment was appropriate because Plaintiff failed to establish a likelihood of confusion, and the Court ultimately agreed.  Logboat was represented by FSM partners Nikki Cannezzaro and Matthew Clifford and associate Joan Sheridan.  Shipyard Brewing Company, LLC v. Logboat Brewing Company, LLC, United States District Court for the Western District of Missouri, Case No. 2:17-cv-04079.

Several news articles were published regarding the successful outcome for Logboat, including an article in the Columbia Missourian, https://www.columbiamissourian.com/news/local/beers-all-around-logboat-brewing-wins-lawsuit-over-trademark/article_bf7597c2-78cc-11e8-9bfa-37720ecf5dda.html.
