Federal Court Grants Summary Judgment in Employment Discrimination Suit
08/07/202411, 2024, the United States District Court for the District of Kansas granted summary judgment in favor of an apartment complex in a federal civil rights lawsuit alleging racial discrimination and retaliation in employment. The suit alleged Title VII violations in terminating Plaintiff. Franke Schultz and Mullen Partner Jill Smith argued Title VII was not applicable in the matter because the apartment complex did not have fifteen or more employees during the relevant time and was not an “employer” under thOn Junee statute. The Court, unpersuaded by opposing counsel’s attempt to aggregate employees with another entity under various theories, granted summary judgment for the employer. The Court’s favorable ruling for the firm’s client has not been appealed.
