Dave Boresi Obtains Dismissal of Traumatic Brain Injury Case
12/01/2022After a hearing on Motions to Dismiss for Lack of Personal Jurisdiction and Failure to State a Claim, the federal court for the Eastern District of Missouri at St. Louis dismissed the firm’s client, an Omaha-based rehabilitation hospital, from a case where Plaintiff was seeking damages stemming from a severe traumatic brain injury to an 18-year old woman after being kicked in the head by a horse at an equine show. The Court found that Plaintiff’s Complaint did not state a cause of action for conspiracy, and that Plaintiff did not meet the burden of proving jurisdiction by exhibits, affidavits or otherwise in responding to the firm’s challenge to the court’s jurisdiction over the rehab hospital.
