Eighth Circuit Affirms Summary Judgment for Home Builder in Copyright Infringement Case
08/19/2021Plaintiffs appealed from the United States District Court for the Western District of Missouri's grant of summary judgment in favor of a home builder on claims for copyright infringement. The Eighth Circuit affirmed the District Court's decision in favor of the home builder. In affirming summary judgment for the insurer, the Eastern District held that there was no substantial similarity between the Plaintiffs' home design and the allegedly infringing home design and also upheld an award of attorney's fees in favor of the home builder. The home builder was represented by FSM partners Nikki Cannezzaro and Matthew Clifford. Designworks Homes, Inc. v. Thomson Sailors Homes, L.L.C., 9 F.4th 961 (8th Cir. 2021).
