Johnson County, Kansas Jury Returns Defense Verdict in Premises Liability Case

John Franke and Niki Long received a defense verdict in a premises liability case in Johnson County, Kansas, on May 10, 2017.  The case stemmed from plaintiff’s fall at Jack Stack BBQ restaurant in Overland Park on July 4, 2014.  As she was leaving the property, plaintiff stepped off a curb and sprained her ankle which required surgery and other follow up treatment.  Plaintiff claimed she stepped in a pothole where the base of the curb met the road and that it constituted a dangerous condition.  Defendants denied there was a dangerous condition on the premises and claimed that plaintiff failed to keep a proper lookout of where she was stepping.  At the end of the trial, plaintiff asked the jury to award $150,000 for medical bills, lost wages, and pain and suffering.  The jury returned a verdict finding neither party at fault for plaintiff’s injury and damages.
