Platte County jury awards minimal damages in loss of consortium claim

08/08/2012

Nick Hillyard recently obtained a favorable verdict for the defendant in Robert Hund v. Ingeborg Crosby in Platte County, Missouri. The plaintiff made a claim for loss of consortium based on his wife's injury in a motor vehicle accident with the defendant. At trial, the plaintiff's expert testified that the plaintiff had and would incur more than $300,000 in actual damages for his loss of household services previously provided by his wife and for personal care services he now has to provide his wife. In his closing argument, plaintiff's counsel asked that the jury award the plaintiff more than $300,000 in actual damages in addition to damages for the plaintiff's loss of the love, affection and companionship of his wife. However, the jury returned a verdict of only $15,500 for the plaintiff.
