Circuit Court Grants Summary Judgment in Wrongful Death Suit
12/06/2023On December 6, 2023, the Circuit Court of Ray County, Missouri granted summary judgment in favor of a cable provider in a premises liability lawsuit alleging wrongful death due to a dangerous condition. The suit alleged that the decedent slipped and fell on a dangerous condition of a parking lot and subsequently passed away from injuries caused or contributed to be caused by the fall. Franke Schultz & Mullen Partner Matthew Clifford presented arguments for the cable company that the plaintiffs failed to establish that the cable company had ownership, possession, or control of the area where the alleged dangerous condition existed. The Court accepted the arguments and granted summary judgment in favor of the firm’s client.
