Cassandra Thomas v. Wiley

Circuit Court of Jackson County, Missouri, Docket #: 02-CV-217487

Judge: C. William Kramer

Keith A. Cary, attorney for defendant.

Type of Claim: Trip and fall.  A 40-year-old female suffered multiple left leg fractures that resulted in a below the knee amputation when she tripped and fell on a tree root at the defendant’s rental property where she was a tenant.  The plaintiff contended that the defendant failed to maintain the premises in a safe condition, and failed to remedy or warn of the known dangerous condition.  The defendant denied liability, disputed the nature of the plaintiff’s injuries and contended that they occurred when she slipped on a grassy slope in the yard during the night while she was wearing sandals and that no tree root problem existed on the property.

Damages Alleged:  Past medical: $174,000

Plaintiff’s Experts: None presented.

Defendant’s Experts:  None presented.

Demand Before Trial: $300,000
