Sedgwick County, KS Jury Finds No Fault to Defendant and Awards No Damages to Plaintiff

Following a four-day jury trial in Sedgwick County, KS, the jury found neither defendant at fault for the motor vehicle accident and therefore awarded no damages to plaintiff.  Plaintiff Audrey Little was a passenger in defendant Alan Little’s vehicle that was involved in an accident at the intersection of Central and Hydraulic in Wichita, KS.  The intersection is controlled by a traffic signal and both defendants claimed they had the green light.  There were no witness to the accident other than family members in each of the vehicles involved.  Defendant Edgington argued that Alan Little had the red light and produced evidence of the light sequence for the intersection at issue and the prior intersection to prove that 93% of the time if the driver enters the first intersection on a green light then the next intersection, Central and Hydraulic, is also green.  Defendant Edgington also had the Traffic Engineer for the City of Wichita testify about the light sequence in an attempt to prove Alan Little was at fault for the accident.  The jury found that neither defendant was at fault.  The case was tried by Pamela Welch, attorney for defendant Alan Little.
