Kansas Court of Appeals Remands Order Certifying Class

Pamela Welch successfully argued that the district court’s order granting class certification to a class of plaintiffs who claim Atlantic Credit & Finance, Inc. unlawfully demanded and collected on debts from Kansas consumers without the proper license from the State of Kansas should be remanded.  The Kansas Court of Appeals agreed with Ms. Welch that the district court did not conduct a proper rigorous analysis and further remanded the case to determine whether the plaintiff’s claims were moot in light of Atlantic’s tender of an offer of judgment.
